SWISS CHEMICALS LEGISLATION

The Swiss chemical law has become a living act since replacement of the act and the regulation on toxic law (Giftgesetz) in 2005. The new Swiss chemical regulation (ChemO) has agreed to the EU force directives 67/548/EEC and 1999/45/EEC on the classification and labeling of substances and preparation. They are valid in EC since years.

The new swiss chemical ordinance is in force since 2005 and has been revised since then 3 times. The biocide Ordinance (VBP) and the Chemical Risk Reduction Ordinance (ORRChem) already have been revised several times since 2005., 1th update on December 2010.

With entry into force of REACH Ordinance (EC) 1907/2006, Switzerland acquired certain assets in the Chemical Ordinance. (Last update 1. december 2012) On the most obvious here is the adoption of Article 31 of the REACH Regulation requirements for Annex II Guide for the preparation of the MSDS. On 20th May 2010 this was replaced by Regulation (EC) 453/2010 for modifying REACH Ordinance 1907/2006. This ordinance contains the specification regarding preparing MSDS. It would be accept also for Switzerland(1.December 2012)

Thus the requirements for preparation, the content, quality and the time (costs) of the SDS and the preparator of the SDS increased thourougly.

Further, due to changes in REACH and in expire of CLP Regulation (EC) 1272/2008 of 16. december 2008 many substances are newly classified.

The preparation of MSDS for Switzerland is described in ChemO Annex 2 and in the guidelines described for SDS in Switzerland. They are relevant for Switzerland in section 1, 8, 13, 15.
